TERMS AND CONDITIONS

In consideration of being allowed to participate in the above listed event, related events and activities, I, the undersigned, acknowledge, appreciate and agree that:

Your deposit – and payment for additional items such as single room occupancy, extra night accommodation, bike hire, etc – provides confirmation of your booking with Masters of Tri.

Once this payment has been confirmed your deposit is non refundable

The total balance for the booking is to be paid 4 weeks prior to your arrival in Spain. If payment is not in line with these timescales, then the booking will be treated as cancelled and we reserve the right to retain the deposits which have been paid.

Bookings made within 4 weeks of travelling will require payment in full in order to confirm the booking.

Masters of Tri will confirm bookings by e-mail.

If you have a special request (such as dietary), please notify Masters of Tri in writing (email will suffice) as soon as possible after booking.

Similarly, the following medical information should be provided by the client in writing (email will suffice) where relevant: Emergency contact: name(s) and telephone number(s), a list any medication currently being taken and instructions (if necessary) on how to administer that medication (if relevant), a list of allergies to any medication along with any other relevant information such as any medical conditions.

The client consents to the release of this medical information to appropriate medical personnel if necessary.

Once your booking is confirmed we guarantee that the cost of your event will not change.

This guarantee by Masters of Tri does not cover changes made by you or members of your party that may add to the cost.

We will always try and accommodate changes made by you; any changes should be advised in writing (email) but we cannot guarantee we will be able to satisfy your requirements, especially if they are close to the date of your event. If you change your outward and/or return date for your event this may be treated as cancellation depending on the availability of accommodation, in which cancellation charges apply as set out below. We regret we are not in a position to assist you in the event of delay at your outward or homeward point of departure

Cancellation by the Client

Cancellation must be in writing (e-mail is fine). We will contact you by email to confirm your requests. You will be liable to pay the balance of the monies in full if you do not notify Masters of Tri of your intention to cancel 4 weeks prior to your event.

If, however you have not paid the balance and we are unable to contact you we will cancel your booking and the cancellation charges below will come into effect.

Should you wish to make any changes to your booking after it has been confirmed and reserved you must advise us of your wishes. Whilst we will endeavour to assist to the best of our ability, we cannot guarantee that we will be able to meet all requests. In extreme situations we may have to cancel your accommodation and reserve the right to do so. This will only occur if a) you fail to pay any of the deposits or final balances in full and on time or b) it becomes necessary for us to cancel your accommodation as a result of circumstances beyond our control including, but not limited to those amounting to ‘Force Majeure’ as defined below.

If we are forced to cancel your accommodation (other than due to your default in payment), we will endeavour to find you alternative accommodation, of at least comparable standard, if available (and paying a supplement or receiving a refund in respect of any price difference) or alternatively give you a full refund of all monies you have paid as soon as possible.

Compensation will not be payable and no liability can be accepted where the cancellation is made as a result of unusual and unforeseeable circumstances beyond our control, the consequences of which we could not have avoided even with all due care. If we are forced to cancel your accommodation after departure where circumstances arise amounting to ‘Force Majeure’ we reserve the right to do so and regret we cannot make any refunds, pay any compensation or be responsible for any cost or expenses incurred by you as a result.

Cancellation charges applicable

Notifying us more than 4 weeks before departure – Loss of deposit.

Notifying us less than 4 weeks before departure – Loss of deposit and total balance*

* If you have not paid the total balance then Masters of Tri will seek to recover the outstanding balance together with any legal costs incurred during this process. Please contact us immediately to discuss any items with your booking.

It is highly recommended that independent travel insurance is taken out to cover your travel and your event booking with us; note that this must cover you for sporting activity and cancellation.

Cancellation or changes by Masters of Tri

Whilst rare, it could at some stage be necessary to make minor or major alterations to the booking and other details both before and after bookings have been confirmed. Although most changes would be minor ones, we reserve the right to do so but will advise you of any issues arising from such changes. If it is necessary to make a significant change before the date of the event, we will advise you as soon as we can. We will then offer you the choice of either accepting the changed arrangements notified to you or to offer an alternative event / date.

Conditions of travel

Masters of Tri will organise all the ground arrangements, accommodation, transfers and activities stipulated in the itinerary referred to on the Confirmed Booking Form but is not responsible for arranging flights, ferry bookings or car hire and can accept no liability for any failures on the part of those agents used by the applicant.

Damage

Any damage to the accommodation or property of Masters of Tri, or any third party by the client whether accidental or deliberate must be paid in full at the time of the damage.

Insurance

Clients must have a comprehensive and valid multi sports insurance policy in place when they arrive and during their stay with Masters of Tri. This policy should include emergency medical care, cover for personal injury, including cover for all activities, including water activities, loss or damage to your luggage, loss or damage to equipment hired or borrowed from us or third parties, repatriation, legal expenses cover and expenses associated with cancellation or curtailment of their booking. You should be in possession of an up to date EHIC card available from your local post office or online before travelling abroad.

You indemnify us from any claim whatsoever resulting from your own insurance cover.

Risks

In accepting these Terms and Conditions, clients understand, agree and acknowledge that some activities may be of a hazardous nature and/or include physical and/or strenuous activity. Understanding this, clients must provide Masters of Tri with a formal statement of any known medical condition or impairment that might inhibit safe and active participation in the event booked in writing (email will suffice).

The client knowingly and freely assumes all such risks, both known and unknown, and assumes full responsibility for her/his participation in the event and willingly agrees to comply with the stated coaching. If the client conducts any non-coached / unaccompanied training it is at her/his own risk.

A cycle helmet MUST be worn at all times whilst riding on the road as required by Spanish road laws.

The client, for herself / himself and on behalf of any heirs, assigns, personal representatives and next of kin, hereby release, indemnify and hold Masters of Tri and lessors of premises used to conduct the event harmless with respect to any and all injury, disability, death, or loss or damage to person or property, to the fullest extent permitted by law.

Masters of Tri does not provide medical insurance coverage and that any applicable medical insurance must be provided by the client. In the case of injury or medical emergency, Masters of Tri has permission to seek, administer, or have administered whatever first aid or emergency medical care deemed necessary for the client’s welfare, and it is understood that the client, and not Masters of Tri, shall be responsible for any and all charges for such health care services regardless of whether the client’s medical insurance would cover such charges.

This does not remove our legal duty of care but is simply used to highlight your acceptance of the risks inherent in the activities in which you are participating.

Force Majeure

We regret we cannot accept liability, make any refunds or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by reason of circumstances amounting to ‘Force Majeure’. Circumstances amounting to ‘Force Majeure’ include any event which we, or the supplier of the service(s) in question, could not, even with all due care, foresee or forestall such a (by way of example and not by way of limitation) war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, acts of God, adverse weather conditions and all similar events outside our control.

Behaviour

All guests are expected to behave with consideration to other guests in order that everybody may enjoy the event. If in our reasonable opinion you or any member of your party behaves in such a way as to cause, or to be likely to cause, distress, danger or annoyance to any third party (including other clients) or damage to property, we reserve the right to terminate the event of the person concerned without notice.

In this extreme situation, our responsibilities towards that person (including any return transport arrangements) will immediately cease and we will not be responsible for meeting any costs or expenses they may incur as a result. In this extreme situation we will also not pay any compensation, or make any refunds to the individual involved, or to members of his/her party or associates that incur additional expense as a result of this action.

Complaints

We take all complaints very seriously and will deal with them personally. If you have any complaint about your accommodation or our services, then please raise them with us as soon as possible. In reality, most complaints can be dealt with quickly and efficiently. If you are still not satisfied, or wish to complain after your event, then please write to us by e-mail within 28 days of your event. We cannot accept liability in respect of any claims not notified to ourselves accordance with this clause.

Passport / Visa

It is clients’ sole responsibility to be in possession of a valid passport and any necessary visas or documentation.
